1. Use of Website
The contents of the
PRO-DNA Diagnostic website and of all the electronic pages on this site may not be used, either in whole or in part, without the prior written
consent of
PRO-DNA Diagnostic. The information posted on the website is updated regularly, but
PRO-DNA Diagnostic cannot be held responsible or liable for any information posted thereon, or for any errors and/or omissions that it may contain. The
PRO-DNA Diagnostic site may also contain links to other websites, the contents of which
PRO-DNA Diagnostic assumes no responsibility or liability.
2. Refund policies
a) The customers who select the 72 hours service cannot obtain a refund.
b) No refund can be given once the laboratory has started the DNA expertise.
c) Customers who wish to obtain a refund, must return, at their expenses, the sampling kit.
d) Customers who wish to cancel a purchase can be refunded for the total amount if they advise the laboratory within a period of 7 days following the purchase date. An administrative charge of $55CAN will be retained. Customers will need to return, at their expenses, the sampling kit.
e)When the period of 7 days is expired, a purchase can be partially refunded upon customers' request within a period of 3 months following the purchase date. Under these circumstances, the purchase amount minus a 125$CAN administrative fee will be refunded. Customers will need to return, at their expenses, the sampling kit.
3. Payment Procedures
Unless otherwise indicated, the laboratory requires full payment for all tests prior to sending the sampling kits and/or starting the tests. Payment may be made by VISA, MasterCard, Interac, postal money order, certified cheque or cash. Certified cheques and postal money orders must be made payable to
PRO-DNA Diagnostic and mailed to 3885 Industriel Blvd., Laval, Quebec, Canada, H7L 4S3. Unless otherwise indicated, payment must be in Canadian dollars (prices shown in US dollars and Euros are approximate and are provided for your information).
4. Consent Policies
The laboratory reserves the right to refuse, at any time, to proceed with a test if it considers that its
consent policies have not been respected. In the event of such a decision, the refund policy detailed in point 2 will be applied.
5. Fortuitous Events
During the course of its activities,
PRO-DNA Diagnostic may be subject to events beyond its control. Such events include, but are not limited to, the loss of kits in the mail, destruction of samples during transportation, breakdown of laboratory equipment, destruction of samples during storage, postal delays, laboratory stock-outs and management disruptions. While our laboratory does everything within its power to limit the impact of such incidents,
PRO-DNA Diagnostic declines all responsibility or liability for damages suffered by customers or third parties who may be impacted by such events.
6. Misuse or Fraudulent Use of Services
In the context of services involving the at-home sampling option, PRO-DNA Diagnostic cannot be held responsible or liable for the misuse of kits or for the improper handling of specimens by third parties. Moreover,
PRO-DNA Diagnostic cannot be held responsible or liable for fraudulent handling by third parties who may be seeking to falsify the results of a test. In cases involving a lack of trust among the participants,
PRO-DNA Diagnostic recommends the use of the
legal purposes service to ensure the integrity of the sampling process and of the chain of custody thereafter.
7. Participant Confidentiality
PRO-DNA Diagnostic places great importance on participant confidentiality in its tests, and thus subscribes to rigorous confidentiality policies. However,
PRO-DNA Diagnostic cannot be held responsible or liable for any breach of confidentiality by third parties.
PRO-DNA Diagnostic therefore recommends that participants in a given test discuss the importance they place on confidentiality amongst themselves in the context of their joint initiative.
8. Governing Laws and Jurisdictional Issues
The present Terms and Conditions are governed by the laws in force in the province of Québec, and any dispute must be submitted to the jurisdiction of the Courts of Montréal.
9. Acceptance of the Terms and Conditions
PRO-DNA Diagnostic considers the fact of using
PRO-DNA Diagnostic's services and website as evidence of the users' acceptance of its Terms and Conditions.
